Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 0 costs, 1 mixed.

SBA access for nonprofit child care

This bill would create a new "covered nonprofit child care provider" category for SBA loan programs. If enacted, qualifying nonprofits that are state-licensed, 501(c)(3), serve children from birth to school age, meet SBA size rules, and run required criminal background checks would be treated as small businesses for SBA 7(a) and 504 loans. Providers would also need to certify non-discrimination and could offer school-age or preschool programs. These changes would take effect upon enactment.

Loan rules for nonprofit child care

If enacted, loans to covered nonprofit child care providers would generally be made with banks or certified development companies and the SBA would take a delayed (guaranteed) role instead of making direct loans. Loans or financings over $500,000 would require an outside guarantee of timely payment, while loans of $500,000 or less would not require that guarantee. The bill would bar using proceeds for First Amendment‑protected religious activities. The SBA would also be prohibited from denying eligibility because the provider is associated with an entity that does protected First Amendment activities.
