Healthcare Workforce Resilience Act
Sponsored By: Senator Durbin, Richard J. [D-IL]
Introduced
Summary
This bill would recapture unused employment-based immigrant visas for nurses and physicians and carve out new slots to help relieve staffing shortages while speeding processing. It ties the new visas to employer attestations that hiring will not displace U.S. workers.

More immigrant visas for nurses, doctors
If enacted, this bill would recapture unused employment-based immigrant visas from FY1992–FY2024 to create up to 40,000 extra visas. Of those, up to 25,000 would be for professional nurses and up to 15,000 would be for physicians. Petitioners must file immigrant petitions within 3 years after enactment to use these visas. Visas from this pool would be exempt from per-country limits and issued by the petition priority date, and family members under INA 203(d) would get visas from the same pool without reducing the nurse or physician totals. USCIS and the State Department would be required to speed processing and consular handling for these cases, and USCIS may not charge a premium processing fee. Before issuing a reserved nurse visa, the petitioner must attest that hiring the nurse has not and will not displace a U.S. worker.
