Sponsored By: Senator Blackburn, Marsha [R-TN]
Introduced
Summary
Conditions Edward Byrne Memorial Justice Assistance Grant Program (Byrne JAG) funds on state driver-license and immigration-information sharing policies. The bill would withhold or require return of those federal public-safety grants from states that issue driver licenses without proof of U.S. citizenship or lawful presence or that block sharing immigration-status information with the Department of Homeland Security.

- States would have to return unobligated Edward Byrne Memorial Justice Assistance Grant Program funds within 30 days after issuing a qualifying license or within 30 days after the bill's enactment. This creates a short deadline for returning funds.
- A state would be ineligible for future Byrne JAG funds until it adopts laws or policies that both stop issuing licenses without proof of lawful presence and allow local or state entities to collect and share immigration enforcement information with DHS.
- Local and state government entities and officials would be required to be permitted to collect, send, and receive immigration enforcement information with DHS, changing data-sharing rules.
- People who lack proof of U.S. citizenship or lawful presence would face states that are pushed to stop issuing driver licenses to them under this bill.

Cut federal justice grants for states
This bill would make a State lose eligibility for Edward Byrne Memorial Justice Assistance Grant funds. That would happen if the State issues a driver's license to someone without proof of U.S. citizenship or lawful presence. It would also target States that ban or limit sharing immigration enforcement information with the Department of Homeland Security. If either rule applies, the State must return any unobligated Byrne JAG funds to the U.S. Treasury within 30 days. For license cases, the 30-day clock starts when the license is issued. For information-sharing bans, the clock starts on enactment. A State would stay ineligible for future Byrne JAG funds until it adopts two policies. It would need to ban those licenses and allow collecting and sharing immigration enforcement information with DHS. The bill would define which grants count as Byrne JAG funds. It would define "immigration enforcement information" to include a person's citizenship or immigration status. It would also include the date, time, and place when someone is released from jail or prison.
