Summary
Linking JAG grant eligibility to restrictions on transactions with certain firearm dealers would condition Edward Byrne Memorial Justice Assistance Grant funding on avoiding purchases from ATF-listed dealers and would expand public ATF disclosures about dealer tracing data.
Show full summary
- State and local law enforcement agencies would have to certify they did not transfer or buy firearms from ATF-listed covered dealers to qualify for JAG grants. This could affect eligibility for grant recipients.
- Licensed firearm dealers would be designated as "covered" if ATF traced at least 25 short time-to-crime firearms to their business; short time-to-crime means three years or less. That designation would appear on a public list.
- The ATF would notify agencies when a firearm they transferred was traced to a criminal offense and would publish a list of covered dealers within 120 days and annually thereafter. The bill removes prior year-based limits on ATF disclosure to allow broader, more frequent public reporting.

ATF to publish covered dealer list
If enacted, the Attorney General, through the ATF Director, would notify a State or local law enforcement agency within 120 days when a gun they transferred was traced to or suspected of being used in a crime. The ATF would publish a list of "covered licensed dealers" on its website and update it every year. A "covered licensed dealer" would be a dealer with at least 25 traced firearms that had a short time-to-crime in at least two of the three calendar years before the list. "Short time-to-crime" would mean three calendar years or less between the retail sale and the recovery of the firearm. The bill would also remove prior year-based limits on ATF public-disclosure language.
JAG grants barred from listed dealers
If enacted, applicants for Edward Byrne JAG grants would need to certify that they, and every grantee or subgrantee in their jurisdiction, do not transfer or buy firearms from any dealer on the ATF's most recent covered dealer list. The restriction would apply at the time of certification and would take effect upon enactment. This could limit where local agencies buy firearms.
