Sponsored By: Senator Ernst, Joni [R-IA]
In Committee
Summary
Relocate at least 30% of Small Business Administration headquarters jobs outside the Washington, DC area. The bill would require that move if the Administrator determines it reduces federal costs and would change pay and telework rules for relocated staff.
Show full summary
- Employees: Would relocate at least 30% of headquarters staff to regional duty stations and recalculate pay to the new locality. Relocated workers could not telework full-time and employees with full-time telework as an ADA accommodation are excluded from relocation but still count toward the 30% goal.
- Small businesses and customers: Would require locations that promote geographic diversity, including rural markets, and ensure adequate regional staffing for in-person customer service.
- Government operations: Would shrink SBA headquarters office space by at least 30% and complete the reduction within two years. It would also require budget justification counts of headquarters staff, field staff, full-time teleworkers, and telework accommodations for disability.
- Legal and labor effects: Would supersede other laws and collective bargaining where needed to implement relocations and would not create a private right of action.

SBA headquarters staff moves and limits
This bill would require the SBA to move at least 30% of its headquarters staff outside the Washington, DC area if the Administrator finds it will cut federal costs. For each moved employee, pay would be recalculated using the new location's pay locality and full-time telework would be barred. Employees with a full-time telework ADA accommodation would not be moved but would still count toward the 30%. The SBA would must notify eligible employees before a report to Congress, file a report within 180 days, give relocation notices 60–90 days after the report, and make moves effective 90 days after notice. Remaining full-time Washington-area teleworkers who are not moved would lose full-time telework 180 days after the report. The bill would bar relocation incentive pay when an employee's official worksite changes from home to SBA headquarters. It would also require cutting headquarters office space by at least 30%, starting within 180 days and finished within two years. Finally, the bill would say it supersedes conflicting laws or union agreements and would not create a private right to sue under the Act.
