  • Patients and communities: The bill aims to block sale or lease terms that the Secretary finds would place public health at risk, helping protect local access to care and reduce the chance of service disruptions.
  • Health care entities and States: Hospitals, clinics, nursing homes, and other covered providers would have to submit sale or lease terms for HHS review. States may enforce the rule, the Secretary may consult State attorneys general, and HHS can step in if a State does not substantially enforce. Civil penalties may be imposed up to $10,000 per violation.
  • Investors and for-profit owners: The bill changes Internal Revenue Code Section 856 rules so rents from "qualified health care property" receive a new tax treatment. The tax changes take effect for taxable years beginning after enactment.

Bill Overview

Analyzed Economic Effects

2 provisions identified: 2 benefits, 0 costs, 0 mixed.

Tax break for REITs renting health property

If enacted, the bill would let REITs and property owners treat rent from certain health care properties as qualifying REIT income under the tax code. It would add a new rule to Internal Revenue Code section 856 and make matching edits elsewhere. The change would apply to taxable years beginning after the law is enacted. This would mainly reduce taxes or increase tax-advantaged income for REIT investors and owners of qualifying health properties.

Block risky REIT deals with providers

This bill would bar health care providers from selling or leasing property to REITs when deal terms could weaken their finances or risk public health. Providers or owning firms would have to submit deal terms to the Secretary of Health and Human Services for review first. States would enforce the rule, but HHS could step in if a State fails to enforce. If violated, the Secretary could impose civil fines up to $10,000 per violation.
