  • Drivers: Commercial motor vehicle operators must be able to converse with the public, read highway signs and signals in English, answer official inquiries, and make entries on reports and records.
  • Enforcement officers: Authorized officers may declare a driver out of service when the driver is found noncompliant with the English requirement.
  • Regulatory effect: The bill says the new out-of-service action does not change other out-of-service orders and that existing federal rules and the North American Standard Out-of-Service Criteria still apply.

New English rule for truck drivers

This bill would require people who operate commercial motor vehicles to read and speak English well enough to: converse with the public; understand highway signs and signals in English; answer official questions; and fill out reports and records. An authorized enforcement officer could declare a driver out of service if they are found not to meet the rule, using the standard in section 391.11(b)(2) of title 49, Code of Federal Regulations (or a successor). That out-of-service declaration would not change other out-of-service orders carried out under Federal law or the North American Standard Out-of-Service Criteria. The bill does not include a phase-in schedule, funding, or a sunset date. If enacted, this could stop some drivers from working and reduce their pay while aiming to improve road safety.
