TREATS Act

Sponsored By: Senator Murkowski, Lisa [R-AK]

Introduced

Summary

Expands telehealth-based prescribing for FDA-approved substance use disorder medications. This bill would allow remote practitioners to perform defined "telehealth evaluations" using two-way audio or audio-and-video systems when prescribing certain Schedule III, IV, or V drugs approved to treat substance use disorder, while still requiring at least one in-person medical evaluation as part of the process.

Show full summary
  • Patients: Would make it easier to get SUD medications by allowing remote evaluations, including audio-only, which may reduce travel and scheduling barriers.
  • Clinicians: Would let a practitioner located away from the patient use the telecommunications systems referenced in section 1834(m) of the Social Security Act to complete the medical evaluation when prescribing eligible SUD medicines.
  • Rules and compliance: Adds a specific definition of "telehealth evaluation" tied to two-way, real-time audio or video and requires that evaluations conform to applicable Federal and State laws.

Telehealth for addiction medication prescriptions

This bill would require at least one in-person medical exam as part of the evaluation to get a controlled-substance prescription. It would add a new definition of a "telehealth evaluation" as a remote medical exam by a practitioner who follows federal and state law. For Schedule III, IV, and V drugs that the FDA approves to treat substance use disorder, it would allow one telehealth visit to count for prescribing. Telehealth could use audio-only or two-way audio-and-video systems, and the distant practitioner would be remote and not a pharmacist. If enacted, these changes would take effect upon enactment.
