Mandatory recalls for China-made products
This bill would let the Consumer Product Safety Commission order mandatory recalls of consumer products tied to manufacturers or retailers located in the People's Republic of China, including Hong Kong and Macao. The Commission could act when the product is sold directly to U.S. consumers, including online, and when a Chinese manufacturer or retailer fails to give a timely or adequate response to the Commission's information or action requests. The bill would create a rebuttable presumption that such a product presents a substantial hazard and would require the Commission to post notice and notify known distributors, importers, and platforms at least 30 days before the recall takes effect. The bill would also treat e-commerce platforms headquartered or primarily operating in China that sell to U.S. consumers as "distributors" under the law, making those platforms subject to distributor obligations for affected products.
