Bill Overview
Analyzed Economic Effects
2 provisions identified: 0 benefits, 1 costs, 1 mixed.
Ban on some foreign surrogacies
This bill would make certain international surrogacy contracts void and unenforceable. That applies when the surrogate is in the U.S. at birth or is a U.S. citizen or lawful permanent resident and the prospective parent is from a listed foreign country. It would also apply when a surrogacy broker arranged the agreement with such a prospective parent. An agreement between a surrogate and two married prospective parents would stay valid if at least one parent is a U.S. citizen or lawful permanent resident. If an agreement is void, the State where the surrogate lives would decide custody by the child's best interests and the contract would not count. A broker who knowingly or recklessly arranges a void agreement could be fined or face up to one year in jail.
Definitions for surrogacy terms
This bill would define key surrogacy terms used in the law. It would treat oral or written and direct or brokered arrangements as surrogacy agreements. It would define who counts as a prospective parent, a surrogate parent, and a surrogacy broker. The bill would also presume a surrogate agreed to give up parental rights when the contract does not say otherwise and the prospective parent is a citizen or lawful permanent resident of a listed foreign country (as referenced in 10 U.S.C. 4872(f)(2)).
