Sponsored By: Senator Mullin, Markwayne [R-OK-2]
Introduced
Summary
Raises and indexes the dollar threshold for when the National Labor Relations Board can decline jurisdiction over categories of employers. This bill would sharply increase those thresholds in 2026 and then tie them to a per‑person spending index so they adjust each year.

- Small businesses and employer classes would see their 2026 threshold set at 10 times the dollar amount that applied the day before enactment. After 2026 the threshold for each class would grow yearly based on the Personal Consumption Expenditure Per Capita Index published by the Bureau of Economic Analysis.
- The National Labor Relations Board would use these class‑specific, indexed thresholds to decide whether to assert jurisdiction over labor disputes for cases decided on or after January 1, 2026 (or the enactment date if later).
- Employees and unions could face fewer NLRB-covered disputes for employers that fall under the raised, indexed thresholds, shifting where some workplace claims are resolved.

Higher NLRB dollar thresholds for businesses
This bill would raise the dollar thresholds the National Labor Relations Board uses to decide whether to take a labor dispute. For 2026, each class or category’s threshold would be set at ten times its pre-enactment amount. After 2026, thresholds would change each year using the Personal Consumption Expenditure (PCE) Per Capita Index relative to 2026. The Bureau of Economic Analysis would publish that PCE per-capita index annually starting in 2027. These rules would apply to Board decisions made on or after the later of January 1, 2026 and the date of enactment.
