NLRB Stability Act
Sponsored By: Senator Cassidy, Bill [R-LA]
Introduced
Summary
Requires NLRB orders to follow the applicable federal circuit's decisions and limits where appeals can be filed. The NLRB Stability Act would add a rule to the National Labor Relations Act that an NLRB order under Section 10 cannot conflict with the court of appeals for the circuit where the alleged unfair labor practice occurred, and it would specify the courts where petitions challenging those orders may be filed.

- Employers and unions: Gain clearer, circuit-specific precedent for labor disputes, which reduces surprise outcomes from conflicting Board orders.
- Parties appealing NLRB orders: Must file petitions in the court of appeals for the circuit where the alleged unfair labor practice occurred or in the D.C. Circuit, replacing the prior ability to file in any forum.
- The NLRB: Faces a binding constraint on nonacquiescence, limiting its ability to diverge from circuit precedent.

New rules for NLRB orders and appeals
This bill would require NLRB orders under Section 10 to follow the federal court of appeals in the same circuit. It would require appeals to go to the court of appeals for the circuit where the unfair labor practice happened. You could also file in the U.S. Court of Appeals for the District of Columbia. If courts of appeals are on vacation, you may file in a district court in that circuit. You may also file in the U.S. District Court for the District of Columbia. If enacted, these changes would take effect upon enactment.
