- Employers and others accused of unfair labor practices would get a prehearing right to inspect any evidence the Board plans to use against them.

New evidence and fines for labor charges
If enacted, the bill would require unfair-labor charges to be filed "in good faith." It would bar the Board from issuing a complaint unless the charge includes either supporting evidence from an identified source (for example, an affidavit, photo, video, email, or text) or a written certification that the filer cannot provide evidence plus a description of the evidence. The bill would let the person charged inspect, copy, test, or sample any evidence the Board will use before the hearing. It would also allow a fine of up to $5,000 for anyone who files a Section 10(b) charge not in good faith or who repeatedly files frivolous charges that fail the evidence or certification rule.
