Sponsored By: Senator Cassidy, Bill [R-LA]

Introduced

Summary

tighten and speed up union elections. This bill would rewrite the National Labor Relations Act to narrow when union votes can occur, raise vote and turnout thresholds, restrict tactics that delay certification, and ban agreements that block solicitation between unions.

Show full summary
  • Workers: Would create a 90-day decertification window that begins 60 days after the Board finds a representative is not bargaining in good faith. It also defines an "initial bargaining phase" that limits when recertification or decertification petitions can be filed.
  • Employers and the NLRB: Would require secret-ballot elections run by the Board and bar certification unless a secret-ballot majority is reached and at least two-thirds of the unit votes. It also limits the Board's ability to delay or dismiss election requests and allows ballots to be impounded for up to 60 days while certain charges are resolved.
  • Labor organizations: Would ban no-raid agreements that prevent unions from soliciting or representing employees. It also tightens procedures for charges that seek to block elections by requiring an offer of proof and prompt disclosure of witnesses.

Bill Overview

Analyzed Economic Effects

5 provisions identified: 1 benefits, 0 costs, 4 mixed.

Limits on union election petitions

If enacted, the bill would make the NLRB dismiss petitions filed before a first collective bargaining agreement is in effect after a valid election. After the first contract starts, new petitions would be allowed only when no contract is in effect or during a 90‑day window that runs from 150 days to 60 days before the end of each two‑year period (health care employers get a 180-to-90 day window). The bill would also bar the Board from delaying petitions just because of a successor employer acquisition.

Secret ballot rules for unions

If enacted, the bill would require the NLRB to run secret‑ballot elections to certify a union. Certification would only issue if at least two‑thirds of all unit employees cast ballots and a majority of those ballots favor the union. The bill would also delay issuing certifications while certain blocking charges are finally decided and would bar using settlements to block or postpone recognition elections.

Ban on agreements that block unions

If enacted, the bill would make it an unfair labor practice for a union to agree with another union not to solicit or try to represent certain employees. The ban targets agreements that stop one union from competing with another to represent workers. This change aims to increase competition among labor organizations.

Ballot impoundment rules for elections

If enacted, the bill would let an NLRB regional director impound ballots for up to 60 days in certain elections when specific unfair labor charges are filed. If a formal complaint issues before 60 days end, ballots stay sealed until a final decision. The filer must also provide a short, written offer of proof naming witnesses and summaries of expected testimony.

Decertification window after bad faith

If enacted, the bill would create a 90‑day decertification window when the Board finds a union did not bargain in good faith during the initial bargaining phase. That window would start 60 days after the Board’s finding and end 150 days after it. The Board must notify employees at least 45 days before the decertification window opens.
