119-s-3142119th Congress

I–VETS Act

Sponsored By: Senator Duckworth, Tammy [D-IL]

Introduced

Summary

Creates a DHS tracking system to identify immigrants who are serving or have served in the U.S. Armed Forces. It would require the Secretary of Homeland Security to annotate immigration and naturalization records when a person applies for a benefit or is placed in an immigration enforcement proceeding. DHS would record whether the person served in a regular or reserve component on active duty or in an active reserve status and would track case outcomes for those individuals. The information collected may not be used to remove the person from the United States.

Record military service for noncitizens

If enacted, the Department of Homeland Security would check whether a noncitizen applying for an immigration benefit or placed in an enforcement case is serving or has served in the U.S. Armed Forces. DHS would add that service status to the person's immigration and naturalization records so outcomes can be tracked. DHS could not use the information gathered under this rule to remove someone from the United States. This would take effect upon enactment.
