National Defense Supply Chain Integrity Act of 2025
Sponsored By: Senator Scott, Rick [R-FL]
Introduced
Summary
Would exempt Defense Department determinations that identify Chinese military companies from the Administrative Procedure Act’s notice-and-comment and judicial-review requirements. It inserts a new subsection into Section 1260H that treats a Secretary of Defense determination under that section as a military or foreign affairs function for purposes of 5 U.S.C. 554 and related APA provisions, thereby removing those APA procedures and judicial review from the identification process.

Fewer legal reviews for Defense listings
This bill would let the Secretary of Defense treat identifications of Chinese military companies as a military or foreign affairs function. If enacted, those determinations under subsection (a) would not be subject to parts of the Administrative Procedure Act. That means agencies would not have to use notice-and-comment rulemaking for these listings. Courts would also have less ability to review those decisions. The change would apply only to identifications made under subsection (a) and would take effect on enactment.
