Flight Risk Reduction Act

Sponsored By: Senator Lee, Mike [R-UT]

Introduced

Summary

Presumes non‑U.S. citizens and non‑lawful permanent residents are serious flight risks and dangers, shifting the burden to those defendants to overcome that presumption. It would require clear and convincing evidence to rebut the presumption and bar using family or employment ties as grounds to rebut it.

  • Non‑U.S. citizen and non‑lawful permanent resident defendants: Would face a statutory presumption that no condition or combination of conditions will reasonably assure their appearance and the safety of others, subject to rebuttal only by clear and convincing evidence.
  • Federal judges and the pretrial process: Would add immigration status as a specific ground in 18 U.S.C. 3142 and reorganize the detention hearing framework to incorporate that new ground, while disallowing family or job ties to defeat the presumption.

Easier pretrial detention for noncitizens

This bill would change who federal judges can hold before trial. If enacted, people charged in federal cases who are not U.S. citizens or lawful permanent residents would be presumed likely to flee and to be dangerous. The presumption would treat no condition or combination of conditions as likely to assure appearance or public safety. A defendant could overcome the presumption only by clear and convincing evidence. Family ties or a job in the United States could not be used to rebut the presumption. The bill would also reorganize detention-hearing language so the new non‑citizen ground is separate. These changes would take effect upon enactment.
