- Employers: Makes it an unfair labor practice for an employer to employ, recruit, or hire an individual who is an unauthorized alien. Employers can avoid liability by making a good-faith effort to verify status using the employment verification system described in INA section 274A.
- Labor organizations: Makes it an unfair labor practice for a labor organization or its agents to represent an unauthorized alien for purposes of collective bargaining. Labor organizations have a parallel good-faith defense if they use the same federal employment verification system.
- Workers: States that discharging an employee who is an unauthorized alien is not evidence that the employer acted with animus against the employee's Section 7 rights or against a labor organization.

Ban on hiring unauthorized workers and representation
If enacted, this bill would make it an unfair labor practice to hire people the INA calls "unauthorized aliens." Labor unions and their agents could not represent those same people in collective bargaining. Employers and unions would have a "good-faith" defense if they used the federal employment verification system described in INA section 274A to check work authorization. In certain unfair labour claims, firing an unauthorized worker could not be used as proof the employer opposed union rights. These changes would take effect upon enactment.
