119-s-3584119th Congress

Stop Illegal Aliens Drunk Driving

Sponsored By: Senator Cornyn, John [R-TX]

Introduced

Summary

Would expand the definition of aggravated felony to cover intoxicated driving that causes death or serious bodily injury. The bill would add a new subparagraph to Section 101(a)(43) of the Immigration and Nationality Act to cover driving while intoxicated, impaired, or under the influence of alcohol, a controlled substance, or any other intoxicating substance when the offense results in death or serious bodily injury. A conviction would count for immigration purposes whether it is labeled a misdemeanor or felony under federal, state, tribal, or local law, and that aggravated-felony designation would enable enhanced immigration enforcement and potential removal actions against noncitizens with such convictions.

New immigration penalties for drunk driving deaths

If enacted, the bill would add drunk-driving offenses that cause death or serious injury to the list of aggravated felonies. It would cover driving while intoxicated, impaired, or under the influence of alcohol, a controlled substance (21 U.S.C. 802(6)), or any other illegal narcotic. Convictions would count as an aggravated felony even if state, tribal, or local law called them misdemeanors. The bill would also make people who are convicted of, or admit to, these acts inadmissible and could bar visas or entry and lead to removal. The changes would take effect on the date of enactment and apply to immigration actions taken on or after that date, regardless of when the conviction occurred.
