SCAM Act

Sponsored By: Senator Schmitt, Eric [R-MO]

In Committee

Summary

This bill would expand civil denaturalization grounds by treating certain post‑naturalization conduct within a set look‑back period as prima facie evidence that a person lacked required moral character and attachment to the Constitution at naturalization. It links denaturalization to retroactive cancellation of the certificate of naturalization and makes the person immediately removable under expedited procedures.

Bill Overview

Analyzed Economic Effects

2 provisions identified: 0 benefits, 2 costs, 0 mixed.

New grounds to revoke citizenship

If enacted, the bill would let the government use certain acts within 10 years after naturalization as proof you lacked good moral character. This covers joining or helping a foreign terrorist group, committing or admitting aggravated felony or specified espionage offenses, or defrauding a government of $10,000 or more (including defrauding public benefits). If a court finds those acts, a court could revoke and cancel your naturalization and void the certificate back to its original date. A person whose certificate is cancelled would be removable through expedited proceedings, and the bill says a court must treat the 10-year window as 5 years if 10 years is held unconstitutional.

Who can bring denaturalization cases

If enacted, the bill would explicitly name the Attorney General as a person who has the duty to bring denaturalization cases. This is an administrative change that makes the Department of Justice a clear duty-holder for these actions. The bill would also add a severability rule. If a court holds any part unconstitutional, the rest of the Act and its other applications would remain in force.
