  • Direct emitters. Facilities in the EPA’s specified reporting categories would get recommended reporting thresholds and standardized methods for calculating and monitoring Scope 3 emissions.
  • Environmental Protection Agency. The EPA would have 1 year to complete a study and publish guidance that covers thresholds, calculation methods by source category, monitoring frequency, quality assurance, estimating missing data, and recordkeeping.
  • Federal and state authorities. The bill preserves the existing authority of the President, federal agencies, and States under current law.

EPA study on Scope 3 emissions

If enacted, the bill would require the EPA Administrator to study and publish guidance on calculating and reporting Scope 3 emissions for covered "direct emitters." The bill would define key terms for that work on enactment, including who counts as a direct emitter, which greenhouse gases are covered, and what "Scope 3" means. EPA would have not more than 1 year after enactment to finish the study and guidance. The guidance would recommend reporting thresholds, give calculation methods by source category, advise monitoring frequency, set quality-assurance checks, explain how to estimate missing data, and describe recordkeeping and reporting practices. This section would not itself make Scope 3 reporting mandatory.
