Show full summary
  • Victims and families: Requires a public report within one year on whether PRC authorities engage in systemic forced organ harvesting and whether those actions meet atrocity standards under U.S. law.
  • Listed individuals: People placed on the bill’s dynamic list would face asset blocking under the International Emergency Economic Powers Act and visa and admission bans. Initial listings must begin within 180 days and the list must be updated at least annually.
  • Humanitarian groups and trade: The bill exempts humanitarian transactions and allows sales of agricultural products, food, and medicine. It also excludes ordinary imports of goods from the sanctions regime.
  • U.S. oversight and enforcement: Agencies must publish an unclassified list with a possible classified annex, report transplant activity metrics and U.S. collaboration history, and the President may issue case-by-case waivers with 120-day reporting.

Analyzed Economic Effects

2 provisions identified: 1 benefits, 0 costs, 1 mixed.

Freeze assets, ban entry for alleged organ harvesters

The bill would require the President to list foreign people tied to forced organ harvesting in China within 180 days and update it within one year and then each year. People on the list would face U.S. asset freezes, and U.S. persons would be barred from dealing with their property; violations would carry civil and criminal penalties under IEEPA. Listed noncitizens would be denied visas and entry, and any current visas would be revoked at once, except where needed to meet U.N. or other treaty duties. The bill would not allow sanctions on imports, and it would allow sales of food and medicine, other humanitarian transactions, and authorized intelligence or law‑enforcement work. The President could waive a sanction case by case for national security and would report any waivers every 120 days. These authorities would end five years after enactment, and the bill would define key terms like “forced organ harvesting” and who counts as a “U.S. person.”

Report on China’s organ transplant system

Within one year, the Secretary of State would report to Congress on China’s organ transplant system, after consulting HHS, NIH, and intelligence. The report would decide whether China now or previously used systemic forced organ harvesting and describe laws and real‑world practices, including for prisoners of conscience. It would estimate yearly transplant numbers, voluntary donors, organ sources, and the typical days to get an organ. It would list U.S. grants in the past 10 years that backed transplant research with China. If forced organ harvesting is found, the report would say whether it qualifies as an “atrocity” under U.S. law.
