Introduced
Summary
Transfer of Clear Creek Hatchery infrastructure to the Nisqually Indian Tribe. This bill would require the Secretary of the Interior, acting through the Director of the U.S. Fish and Wildlife Service, to convey all United States right, title, and interest in the hatchery’s defined “covered infrastructure” to the Nisqually Indian Tribe for no consideration and subject to valid existing rights, within 90 days after enactment. The covered infrastructure lists items such as ponds, springs, dams, a fish ladder, raceways, wells, pipes, fences, roads, and related conduits. The Secretary must finalize maps and legal descriptions, let the map control if there is a discrepancy, allow minor corrections by mutual agreement, and keep the final maps and descriptions on file for public inspection.

Transfer Clear Creek Hatchery to Tribe
This bill would direct the Secretary of the Interior, through the U.S. Fish and Wildlife Service Director, to deed Clear Creek Hatchery infrastructure to the Nisqually Indian Tribe. The transfer would give the tribe all U.S. rights, title, and interest in the listed hatchery infrastructure. The conveyance would be for no consideration and would be subject to valid existing rights. The transfer would have to be completed not later than 90 days after enactment. Covered infrastructure would include ponds, springs, dams, raceways, an incubation room, wells, a water tower, pipes, conduits, fences, roads, and other related items listed in the bill. The bill references two covered maps titled "Nisqually Indian Tribe Clear Creek Hatchery Lower Site" and "Nisqually Indian Tribe Clear Creek Hatchery Upper Site," both dated December 3, 2024. The Secretary would finalize controlling maps and legal descriptions as soon as practicable. If a map and legal description conflict, the map would control. The Secretary and the Tribe could mutually correct minor mapping errors, and the finalized maps and legal descriptions would be filed and available for public inspection at Fish and Wildlife Service offices.
