Gas Prices Relief Act of 2026

Sponsored By: Senator Kelly, Mark [D-AZ]

Introduced

Summary

A temporary federal gasoline tax holiday would zero the federal excise tax on gasoline sold, entered, or removed for consumption before October 1, 2026. It would also require transfers from the general fund to replace the lost receipts for the Highway Trust Fund and the Leaking Underground Storage Tank Trust Fund, and it directs Treasury to enforce that the tax cut is passed to consumers.

Bill Overview

Analyzed Economic Effects

2 provisions identified: 2 benefits, 0 costs, 0 mixed.

Protect highway and cleanup funds

If enacted, the bill would require the Treasury to transfer money from the general fund to the Highway Trust Fund and to the Leaking Underground Storage Tank Trust Fund. Transfers would equal the receipts those funds would have gotten but for the temporary gas tax rate change. The bill would also require those transferred amounts to be counted as section 4081 receipts for allocation: amounts to the LUST fund would be treated as LUST-attributable, and amounts to the Highway Trust Fund would be treated as non-LUST section 4081 receipts. These rules would apply from the date of enactment through October 1, 2026.

Lower federal gas tax for drivers

If enacted, the bill would set the federal gasoline excise tax rate to zero for gasoline removed, entered, or sold from the date of enactment through October 1, 2026. It would also exempt the Leaking Underground Storage Tank (LUST) financing rate for that gasoline. The bill would state that fuel producers and dealers must lower pump prices to reflect the tax cut. Dealers who fail to pass the reduction to consumers would face monetary penalties at least equal to the unpaid tax reduction, and the Secretary of the Treasury would be required to enforce this rule.
