Whistleblower Anti-Gag Act of 2026
Sponsored By: Senator Grassley, Chuck [R-IA]
Introduced
Summary
Expands federal anti-gag protections to certain nondisclosure agreements. This bill would amend 5 U.S.C. 2302(a)(2)(C)(i) to include nondisclosure policies, forms, or agreements described in 5 U.S.C. 2302(b)(13) under the Whistleblower Protection Act's ban on gagging whistleblowers. The change only broadens which nondisclosure instruments are covered and does not create new programs, funding, or additional remedies beyond altering that coverage.

Stop nondisclosure agreements from silencing whistleblowers
If enacted, this bill would add nondisclosure policies, forms, and agreements described in 5 U.S.C. 2302(b)(13) to the Whistleblower Protection Act's anti-gag rule. If you are a federal employee or someone covered by that subsection, such an agreement could not legally stop you from reporting wrongdoing or taking part in whistleblower proceedings. The bill does not set an effective date or change remedies or funding.
