Bill Overview

Analyzed Economic Effects

2 provisions identified: 0 benefits, 1 costs, 1 mixed.

Ban on settlement payments to Presidents

If enacted, the bill would bar certain people from getting settlement payments or other payments from the United States. The rule would apply to the President, the Vice President, some former Presidents, their spouses and dependent children, and trusts or entities for their benefit. Covered individuals could not recover money by settlement, consent decree, administrative resolution, or similar deals, and agencies could not process such claims. Willful violations could require disgorgement of payments, a civil penalty at least $1,000,000 or equal to the payments, up to 5 years in prison, and officers who cause violations could face up to $50,000 and 6 months in jail. The bill would also set a 10-year limit to bring enforcement actions and would pause the filing clock while a person is a covered individual.

Stricter rules for former officials' claims

If enacted, former covered individuals could bring claims or suits only under strict procedural rules. Agencies would have to use a career expert removable only for good cause to lead review, and employees appointed by the covered individual could not take part. Courts would limit awards to actual or compensatory damages and could award them only if the court appoints an independent counsel to represent the agency and the agency cooperates. All filings and proceedings would be publicly and freely available online, including contemporaneous audio. Agencies must publish agreement terms in the Federal Register within 7 days and report claims and decisions to congressional committees as required.
