New penalties for illegal vape imports
If enacted, the bill would make it illegal to bring unauthorized vaping products (ENDS) into the United States after enactment. It would create civil fines per unit: up to $5,000 for fraud, $1,000 for gross negligence, or $500 for negligence. Penalties could be multiplied: up to 2x for transshipment or origin-falsification, up to 3x for repeat violations within 3 years, and up to 5x if both apply. A shipment's total fine could not exceed 1,000 percent (10 times) of its U.S. estimated retail value. Each entry or attempted entry would count as one violation, and the bill would apply existing Customs (section 592) penalty and review procedures. The bill would define "unauthorized ENDS," "unit," and let the Commissioner of CBP set the shipment retail value. It would also preserve FDA, CBP, DOJ, and other agencies' existing enforcement powers.
