Bill Overview

Analyzed Economic Effects

3 provisions identified: 1 benefits, 1 costs, 1 mixed.

Cut federal grants to sanctuary areas

This bill would bar any State or local government labeled a 'sanctuary jurisdiction' from receiving many federal grants. Examples include some K‑12 and higher education grants, arts and environmental education funding, and ARRA stabilization funds. Money that would have gone to a sanctuary jurisdiction would be withheld and reallocated to non‑sanctuary places under the statute's formulas. A State attorney general could sue to require withholding when a released individual later commits a qualifying crime in another State.

Shift liability for detainer compliance

This bill would treat a State or local government and its officers as acting for DHS when they follow a DHS detainer. That would shift legal authority and most liability to the federal government and channel claims under the Federal Tort Claims Act. The bill would not protect anyone who knowingly violates a person's civil or constitutional rights. The change would take effect upon enactment.

Set aside 25% for small grants

This bill would require that at least 25 percent of Section 6(i) funds under the National Environmental Education Act be set aside for small grants. The bill also adds a labeled 'Maximum amount' heading for those grants. The change would start upon enactment.
