No Licenses for Illegal Drivers or Truckers Act of 2026

Sponsored By: Senator Barrasso, John [R-WY]

Introduced

Summary

This bill would make _withholding federal highway funds_ from states that issue driver’s licenses or ID cards without verified lawful presence the main enforcement tool. It would require states to use Department of Homeland Security (DHS) approved electronic checks, FBI fingerprint checks, and Social Security or immigration database confirmations before issuing licenses or personal ID cards.

Show full summary
  • States: A state that lacks a law to require and verify lawful presence would face a 10 percent cut to its annual highway apportionment on October 1, 2026 and each October 1 thereafter until it adopts compliant rules. If the Secretary determines a state is compliant during the fiscal year, the withheld funds are returned to that state when compliance is found.
  • People applying for IDs: Applicants would need valid, unexpired DHS-issued proof of citizenship, national status, or lawful permanent residence to get a driver’s license, commercial driver’s license, or state personal identification card.
  • Funding redistribution: Funds withheld from noncompliant states would be redistributed the following October 1 to states that meet the verification rules so each compliant state gets a share based on its usual highway apportionment.

Bill Overview

Analyzed Economic Effects

2 provisions identified: 0 benefits, 1 costs, 1 mixed.

Stricter ID checks for license applicants

If enacted, the bill would require States to demand and verify proof of lawful presence for every driver license, commercial license, or State ID applicant. "Evidence of lawful presence" would count only U.S. citizens, U.S. nationals, or lawful permanent residents. States would have to use Homeland Security-approved checks that electronically validate name, photo, and fingerprints; run background and FBI fingerprint checks; and confirm an applicant's Social Security number or ITIN with IRS, SSA, or USCIS SAVE. These rules would take effect October 1, 2026. The bill would not change States' existing REAL ID obligations.

States face highway-fund cuts

If enacted, the bill would let the Secretary withhold 10% of a State's annual highway apportionments on October 1, 2026, and each October 1 after. The withholding would apply when a State does not have and is enforcing the required verification law. Withheld funds would not be available to the State unless the Secretary finds the State in compliance before the fiscal year ends. If not returned, the money would be redistributed on the first October 1 after that fiscal year to States that are in compliance, divided by each State's normal apportionment share.
