Bill Overview

Analyzed Economic Effects

2 provisions identified: 0 benefits, 0 costs, 2 mixed.

Ban on importing drugs from China-linked sponsors

If enacted, the Secretary would give U.S. Customs and Border Protection a list of drugs whose sponsor or approved holder is PRC-, CCP-, or PLA-affiliated. CBP would have to refuse entry and destroy any imported drug on that list and would not allow the owner to export it first. CBP could waive the refusal if the Secretary finds refusing the import would create or worsen a U.S. drug shortage. A sponsor or approved-holder so listed could either show it is no longer affiliated or, within 180 days, sell the approved application to a non‑affiliated entity. The process would let them appear before the Secretary and present testimony, and the Secretary would notify CBP if satisfied.

New review and approval limits for China-linked drugs

If enacted, HHS would use new definitions to decide which drug sponsors are tied to the People's Republic of China. The Secretary would review applications filed on or after enactment and applications filed from January 1, 2016 through the day before enactment. The Secretary could review any Drug Master File referenced by those applications. The Secretary would not approve any drug application submitted on or after enactment if the sponsor is found to be PRC-, CCP-, or PLA-affiliated. The bill would authorize $5,000,000 to carry out these reviews and related work; funds would remain available until expended.
