Critical Infrastructure Airspace Defense Act

Sponsored By: Senator Cotton, Tom [R-AR]

Introduced

Summary

This bill would let owners and operators of designated high-risk critical infrastructure detect, track, and mitigate in-flight unmanned aircraft threats. It pairs that authority with mandatory federal training and certification and with real-time coordination with the national airspace system.

  • Owners and operators: Owners and operators of designated high-risk sites would be able to deploy counter-unmanned aircraft system technologies from a joint authorized list to address credible UAS threats after staff complete federal training and certification. Seized unmanned aircraft could be forfeited under the laws of the jurisdiction where seizure occurred and a grant program would help fund acquisition and operation of covered systems.
  • Security personnel and contractors: Only personnel trained and certified under a national program administered by the Secretary of Homeland Security, in coordination with the Department of Energy and the Federal Aviation Administration, would be allowed to exercise the authority. The program sets legal, operational, and technical proficiency standards.
  • Airspace coordination and oversight: The bill would require real-time coordination with the Federal Aviation Administration, issue regulations and guidance within 180 days, require an initial report to Congress within one year and biannual reports thereafter, and it sets a statutory expiration date of Sept. 30, 2031.
