Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 0 costs, 1 mixed.

New federal right to sue herbicide makers

If enacted, this bill would let you sue in federal court if you are physically hurt by exposure to elemental phosphorus or a glyphosate-based herbicide made, sold, or supplied in the United States. You would be able to seek medical costs, lost wages, pain and suffering, wrongful death damages, punitive damages, injunctive or declaratory relief, and attorney fees and costs. The bill would define who counts as a covered entity (makers, sellers, suppliers, contractors, and similar parties). It would also stop covered entities from using federal-immunity defenses and would preserve state-law claims and cases already pending.

Blocks federal funds for herbicide order

If enacted, the bill would prohibit any Federal funds from being used to implement, administer, or enforce Executive Order 14387. That Executive Order seeks to promote national defense by ensuring adequate supplies of elemental phosphorus and glyphosate-based herbicides. The effect on supply, prices, or household costs is uncertain and not estimated in the bill.
