Protecting Human Rights and Public Health in Foreign Assistance Act

Sponsored By: Senator Shaheen, Jeanne [D-NH]

Introduced

Summary

Strips out three State Department rules on foreign aid that dealt with life, equity ideology, and gender ideology in foreign assistance programs. The bill would treat those final rules as though they never took effect and stop similar replacements from being adopted.

Show full summary
  • It would nullify three specific Department of State final rules by name: Protecting Life in Foreign Assistance; Combating Discriminatory Equity Ideology in Foreign Assistance Rules; and Combating Gender Ideology in Foreign Assistance.
  • It would prohibit any federal department or agency from implementing, enforcing, proposing, finalizing, or otherwise adopting successor or substantially similar rules.
  • It would require retroactive treatment so the rules are considered never to have taken effect, removing their operational or policy effects on foreign assistance programs and recipients.

Ban three State Department rules

This bill would declare three Department of State final rules on foreign assistance to have no force or effect. The rules are: Protecting Life in Foreign Assistance (91 Fed. Reg. 3319; January 27, 2026), Combating Discriminatory Equity Ideology in Foreign Assistance Rules (91 Fed. Reg. 3345; January 27, 2026), and Combating Gender Ideology in Foreign Assistance (91 Fed. Reg. 3332; January 27, 2026). It would treat those rules as if they never took effect and make the repeal retroactive. It would bar any federal department or agency from proposing, finalizing, implementing, administering, enforcing, or otherwise adopting those rules or any successor or substantially similar rules. If enacted, this would mainly affect federal agencies, organizations that run or receive U.S. foreign aid, and foreign recipients. It would take effect upon enactment and would have limited direct effect on most U.S. household finances.
