Sponsored By: Senator Kennedy, John [R-LA]
Introduced
Summary
This bill would cap out-of-pocket costs for selected insulin products at the lesser of $35 per 30-day supply or 25% of the negotiated price, and create a reimbursement program to help uninsured people afford insulin. It would also align the same cost-sharing rules across the Public Health Service Act, the Employee Retirement Income Security Act, and the Internal Revenue Code and authorize agencies to issue guidance for implementation.

Bill Overview
Analyzed Economic Effects
2 provisions identified: 1 benefits, 0 costs, 1 mixed.
Lower insulin costs for insured
If enacted, for plan years starting January 1, 2027, group and individual health plans would cover selected insulin products with no deductible. In-network cost-sharing per 30-day supply would be the lesser of $35 or 25% of the plan's net negotiated price. Any payments you make would count toward your deductible and out-of-pocket maximum. Plans would not have to cover insulin from out-of-network providers and could charge higher out-of-network cost-sharing. Insurers would not count the deductible-free insulin when calculating a plan's ACA actuarial value. HHS, Labor, and Treasury would be able to issue guidance to implement these rules.
Insulin help for uninsured people
If enacted, HHS would set up a program for uninsured people to get insulin starting January 1, 2027. For each 30-day supply, HHS would pay the pharmacy or provider the difference between the person's out-of-pocket cost and $35. The provider must agree not to bill the uninsured person for the part HHS pays. 'Uninsured' means you do not have benefits for that insulin product under a specified health plan.
