Supporting Made in America Energy Act

Sponsored By: Senator Daines, Steve [R-MT]

Introduced

Summary

This bill would make aggressive, mandatory oil and gas leasing the federal standard to speed domestic energy production. It would force regular onshore and offshore lease sales, set regional terms and schedules, and limit executive authority to pause leasing.

Show full summary
  • States and energy companies: It would require a minimum of four onshore lease sales each year starting in fiscal year 2025 in specified Western and Plains States and other eligible states, and it would force replacement sales if a sale is canceled.
  • Gulf of Mexico and protected areas: It would require at least two region-wide Gulf lease sales each year beginning fiscal year 2026 through 2035 using Gulf Sale 261 terms, while extending an eastern Gulf moratorium and adding the South Atlantic and Straits of Florida planning areas to that moratorium through December 31, 2035 with narrow environmental exceptions.
  • Alaska and federal process: It would demand at least six Cook Inlet offshore lease sales over ten years with a 12.5 percent royalty rate and would bar the President from unreasonably pausing or canceling federal leasing without congressional approval, creating a rebuttable presumption against such executive actions.

Bill Overview

Analyzed Economic Effects

3 provisions identified: 0 benefits, 0 costs, 3 mixed.

Mandatory onshore oil and gas leases

If enacted, the bill would require the Interior Secretary to hold at least four onshore oil and gas lease sales each year starting in fiscal year 2025. The listed States include Wyoming, New Mexico, Colorado, Utah, Montana, North Dakota, Oklahoma, Nevada, and any other State with federally available leasing land. The Secretary must offer all parcels eligible under each State resource plan, and if a sale is canceled, delayed, or deferred for any reason, a replacement sale must occur in the same calendar year.

New offshore leasing schedule and limits

If enacted, the bill would set a strict schedule and rules for offshore oil and gas leasing. It would require at least two Gulf-wide lease sales each year from fiscal 2026, using the same terms as Gulf Lease Sale 261, with target sale dates of March 31 and August 31 each year through 2035. It would extend the eastern Gulf leasing moratorium to December 31, 2035 and add South Atlantic and Straits of Florida areas, while protecting existing valid leases and allowing environmental conservation leases in moratorium areas. It would also bar the President from pausing or canceling leasing without Congress and require the Interior Department to begin the next offshore leasing program within 36 months and approve subsequent programs at least 180 days before the prior program ends.

Cook Inlet lease sales and royalties

If enacted, the bill would require at least six offshore lease sales in the Cook Inlet Planning Area during the 10 years after enactment. Each sale must offer at least 1,000,000 acres. If a tract gets an acceptable bid, the Secretary must issue the lease to the highest bidder within 90 days. The royalty rate for those leases would be set at 12.5 percent.
