Bill Overview

Analyzed Economic Effects

2 provisions identified: 2 benefits, 0 costs, 0 mixed.

Protections for service members' discipline

If enacted, a commanding officer could choose not to punish a service member for a first-time possession or use of a dietary supplement that contains a prohibited ingredient. The member must meet a statutory "good faith" test and agree to education, counseling, or drug testing instead of discipline. The protection would not apply if the supplement contains a substance listed in the schedules under 21 U.S.C. 812. The bill would also say such possession (other than scheduled controlled substances) would not count as "drug abuse" under title 10.

New banned-supplement list and tools

If enacted, the Secretary of Defense would publish two lists of banned dietary supplement ingredients and performance-enhancing substances and update them at least every 90 days. The lists must be available in three formats: a website viewable in full without search, a searchable database, and a downloadable file. Within 120 days the Secretary would update DoD Instruction 6130.06 and report to Congress on steps to stop DoD-affiliated stores from selling products with banned ingredients. Within one year the Department would update the Operation Supplement Safety website with better search tools, AI label-scanning, and optional user alerts, and would review adding supplement-safety education to training programs.
