Preventing Fugitive Fraudsters Act
Sponsored By: Senator Ernst, Joni [R-IA]
Introduced
Summary
Requires defendants indicted for certain fraud and money‑laundering crimes to surrender passports and avoid international travel while awaiting trial. The Preventing Fugitive Fraudsters Act would add a pretrial release condition to 18 U.S.C. 3142 for indictments under sections 666, 1343, 1956, and 1957. It would require defendants to turn in any passport or passport card and abstain from international travel unless a judicial officer issues written findings that the surrender or travel prohibition is unnecessary or should be modified.

Passport surrender for fraud defendants
This bill would add a pretrial release condition for people indicted under certain federal fraud laws (18 U.S.C. 666, 1343, 1956, and 1957). Those defendants would have to surrender any passport or passport card and not travel abroad while released before trial. A judge could decline or modify that requirement only by writing specific findings of fact that surrender or the travel ban is unnecessary to ensure the person's appearance. The change would take effect upon enactment and would not change other pretrial release rules.
