Sponsored By: Senator Cornyn, John [R-TX]
Introduced
Summary
Expands the definition of a "foreign instrumentality" to include entities domiciled in certain foreign nations. This bill would change 18 U.S.C. 1839 so that being based in a designated "covered nation" can make an entity a foreign instrumentality, not just ownership ties.

Foreign instrumentality rule for covered nations
This bill would change how federal law defines a "foreign instrumentality" for economic espionage. It would keep "substantially owned" and add entities "domiciled in a covered nation." "Covered nation" would be the list in 10 U.S.C. §4872. If enacted, prosecutors could more easily treat companies in those nations as foreign instrumentalities in espionage cases. That could help U.S. businesses and owners of intellectual property by expanding enforcement tools. It would also raise legal risk for companies domiciled in the listed foreign nations.
