VA recoupment from disability pay
If enacted, the VA would be able to recoup certain separation, severance, or readjustment pay from your veterans' disability compensation. The VA could collect the money in monthly installments, a lump sum, or another payment plan. Any monthly deduction could not be more than 25% of your monthly disability compensation. You would be able to apply for a hardship waiver to stop deductions if they would create financial hardship. The VA would have to issue final rules within 90 days after enactment. The rules would take effect the first day of the first month after final rules are published in the Federal Register and would apply to disability compensation paid on or after that date. The bill treats "veterans' disability compensation" as the term "compensation" in 38 U.S.C. 101.
