States could lose federal highway funds
If enacted, the bill would call a State "noncompliant" if it lets people unlawfully present get a driver's license or other ID. Starting October 1, 2026, and on each October 1 after, the Transportation Secretary would withhold 100% of the amounts a noncompliant State would otherwise get under paragraphs (1)–(3) of 23 U.S.C. 104(b). If the Secretary finds a State is no longer noncompliant before the fiscal year ends, the Secretary would apportion any withheld funds that remain available on the first day that determination is made. Amounts withheld and not released by year-end would be redistributed on the next October 1 to States that are not noncompliant, with each receiving a proportional share. If a State later becomes noncompliant after funds were released, withholding would start in the fiscal year after that change.
