119-s-5658119th Congress

A bill to prohibit the construction of data centers on Federal land, and for other purposes.

Sponsored By: Senator Wyden, Ron [D-OR]

Introduced

Summary

This bill would ban construction of data centers on Federal land. It uses the Energy Independence and Security Act of 2007 definition of “data center” and covers National Forest System land and land managed by the Interior Department. The ban would not apply to land inside Indian reservations, pueblos, or rancherias or to land held in trust or otherwise owned by tribes or tribal individuals. Any Federal land conveyed on or after enactment would have to include a reversion clause so the land returns to the United States if it is used for a data center, unless Congress specifically authorizes that use.

Ban on data centers on federal land

This bill would prohibit construction of data centers on Federal land. It would define “data center” by referring to section 453(a) of the Energy Independence and Security Act of 2007. For this rule, “Federal land” would include National Forest System land and land managed by the Secretary of the Interior, but would exclude land inside Indian reservations, pueblos, or rancherias and certain trust or restricted-title Indian lands. Any Federal land conveyed on or after enactment would have to include a clause saying the land reverts to the United States if it is used for a data center, unless Congress specifically authorizes that use by law.
