  • Prime contractors: Must certify they will use plain writing and add that clause to subcontracts. If the SBA finds a solicitation was not plain, the contractor must reissue the solicitation in plain writing within 30 days.
  • Small Business Administration: Would have to write rules to implement the new representation and compliance steps within 90 days and oversee enforcement.

Plain-writing rules for prime contractors

This bill would require offerors or bidders acting as prime contractors to represent they will use plain writing for all subcontract solicitations. It would also require prime contractors to include that plain-writing requirement in any subcontract that offers subcontracting opportunities. The Small Business Administration (SBA) Administrator would have 90 days after enactment to issue rules to implement these requirements. If the SBA determines a prime contractor failed to use plain writing, the prime contractor would have 30 days to reissue the solicitation in plain writing.
