Crypto ATM Fraud Prevention Act of 2025
Sponsored By: Senator Durbin, Richard J. [D-IL]
Introduced
Summary
This bill would create a federal registration and anti‑fraud framework for physical virtual currency kiosks. It targets kiosk scams by requiring operators to register locations and addresses, give clear disclosures and receipts, use blockchain analytics, limit new‑customer transactions, and provide refund rights and enforcement tools.
Show full summary
- Operators would have to register each kiosk and update the list every 90 days with legal and trade names, physical addresses, start/end dates, and every virtual currency address. They would appoint a full‑time compliance officer who is not the CEO and owns no more than 20% of the operator.
- Consumers would get mandatory pre‑transaction disclosures, acknowledgments, physical receipts within one year, and a refund process for fraud claims. New customers face transaction caps of $2,000 per 24 hours and $10,000 total, and refunds must be issued within 30 days for fraud‑induced transactions.
- Enforcement and oversight would rely on FinCEN and law enforcement channels, mandatory operator hotlines, blockchain analytics checks, civil penalties of $10,000 per violation per day, and treble damages or $10,000 minimum for willful refund denials.

Bill Overview
Analyzed Economic Effects
4 provisions identified: 1 benefits, 1 costs, 2 mixed.
Rules and penalties for kiosk operators
If enacted, anyone who owns or runs a crypto kiosk would be covered and must register kiosk locations with Treasury and update that list at least every 90 days. Operators would need a written anti‑fraud policy filed with FinCEN within 90 days of starting, a full‑time compliance officer who is not the CEO and owns ≤20%, and blockchain analytics to block wallets linked to fraud. FinCEN could request evidence of compliance. Civil fines of $10,000 would apply for each violation, with each day a continuing violation treated as a separate violation.
Receipts and refund rights for customers
If enacted, operators would have to give a receipt for every kiosk transaction. Receipts would list operator contact, customer name, transaction hash, USD amount, all fees, refund policy or URL, and law‑enforcement contact. Physical receipts at kiosks would be required within one year. To get a refund you would need to file a police report with a sworn affidavit and apply to the operator within 30 days. New customers could get the full USD transaction amount back, including fees. Existing customers could get transaction fees refunded. If an operator willfully denies a valid refund, the operator could owe three times the refund or $10,000, whichever is greater.
New customer limits and confirmations
If enacted, a "new customer" (the 14‑day period after first kiosk use) would be limited to $2,000 per 24 hours and $10,000 total during that period. Operators would have to show clear, conspicuous fraud warnings and get customer acknowledgement before each sale. For transactions of $500 or more with a new customer, operators would be required to obtain live verbal confirmation by phone or video that the customer wants to proceed and is not being fraudulently induced. Operators would also have to provide live customer service while kiosks accept transactions and give a dedicated law‑enforcement contact to FinCEN within 90 days.
State and federal kiosk rules
If enacted, the federal kiosk rules would override state laws only where those state laws conflict with the federal section. States would still be allowed to pass laws that give customers stronger protections than the federal rules.
