Critical Mineral Consistency Act of 2025
Sponsored By: Senator Lee, Mike [R-UT]
In Committee
Summary
Creates a single, periodically updated federal list of critical minerals and materials. This bill would add a new statutory "Critical Minerals and Materials List" and set firm deadlines for publishing and updating it to align agency definitions and program use.
Show full summary
- Federal program administrators would have to use the most recently published list when running programs that reference the law. This makes the list the official reference point for covered federal activities.
- The list must include any critical mineral designated under subsection (c) and any non-fuel mineral, element, substance, or material the Secretary of Energy has designated under subsection (a)(2). The Secretary must publish the list within 45 days of enactment and update it within 45 days after any new designation.
- The Secretary of the Interior and the Secretary of Energy would be directed to coordinate updates "to the maximum extent practicable" so agency designations stay aligned.
- The bill also inserts the phrase "minerals or materials" into existing language, redesignates a subsection, and amends the statutory title to reflect the harmonized list.

Unified critical minerals list for agencies
This bill would change one phrase in the Energy Act to read "critical minerals or materials" upon enactment. It would require the Secretary to publish a "Critical Minerals and Materials List" within 45 days after enactment. The List would have to include any mineral the Secretary has designated and any non-fuel material the Energy Secretary had listed as critical on the enactment date. The Secretary would have to update the List within 45 days after either Secretary changes a designation, and federal agencies that use these definitions would have to use the most recently published List when they run programs. The Secretary and the Energy Secretary would be directed to coordinate update timing to the maximum extent practicable.
