Sponsored By: Senator Kaine, Tim [D-VA]
Introduced
Summary
Bars unauthorized U.S. military action against Cuba. This bill would direct the President to remove United States Armed Forces from hostilities within or against Cuba unless Congress issues a declaration of war or a specific authorization for the use of military force. It preserves the United States’ right to defend itself from an armed attack and to carry out lawful counternarcotics operations, and it frames the removal requirement under the War Powers Resolution and related statutes.

Limit U.S. military action against Cuba
This bill would direct the President to remove U.S. Armed Forces from hostilities in or against Cuba. The removal would apply unless Congress has declared war or passed a specific authorization for use of military force. The bill would say that force in or against Cuba counts as entering hostilities under the War Powers Resolution. That includes Coast Guard blockades or quarantines. Because of that classification, Congress would be able to use expedited procedures to require removal of forces under existing law. It would not prevent the United States from defending itself after an armed attack or from lawful counternarcotics operations, and it would not create new funding.
