Summary

Human rights accountability for U.S. removals to the Democratic Republic of the Congo (DRC) is the core goal of this resolution. It orders a single, detailed State Department statement that documents alleged abuses and explains U.S. actions and safeguards.

Show full summary
  • People the U.S. returns or sends to the DRC will have alleged abuses and their treatment documented, including unlawful arrest, torture, enforced disappearances, trafficking, and the legal status they are given.
  • Congress will receive a comprehensive, interagency statement within 30 days that describes the DRC's human rights practices and what the U.S. has done or will do to discourage abuses and protect affected individuals.
  • The State Department must assess whether U.S. security assistance or agreements could enable rendition, trafficking, detention, or imprisonment and must describe individualized pre-removal assessments, assurances sought, and identify individuals sent to the DRC in 2025–2026.

Report on DRC human rights

This resolution would ask the Secretary of State to send a written statement about human rights in the Democratic Republic of the Congo. The report would be prepared with the Assistant Secretary for Democracy, Human Rights, and Labor and the State Department Legal Adviser. It would be delivered to the Senate Foreign Relations Committee and the House Foreign Affairs Committee within 30 days after adoption. The report would list credible allegations of abuses, such as unlawful arrest, detention, torture, due process violations, disappearances, killings, and trafficking, and it would focus on non-citizens removed to the DRC by the United States. It would describe U.S. steps to promote human rights, pre-removal individualized assessments, assurances of humane treatment or legal status, and whether U.S. security assistance could enable rendition or detention. It would also include detention conditions, any agreements or payments linked to removals, people sent to the DRC in 2025 and 2026, and a summary of 2025–2026 meetings between DRC and Washington-based U.S. officials. The resolution would not authorize new funding; it would only request this one-time information briefing to Congress.
