- Communities with former BRAC military sites become a new category eligible for nomination as Qualified Opportunity Zones under section 1400Z-1(c)(1)(C). Tracts that do not meet the existing low-income tests will not be treated as low-income communities under the added rule.
- States may increase the number of tracts they designate by the number of BRAC tracts they nominate during the applicable designation period. This effectively expands the pool of tracts available for designation beyond current limits.
- The amendments apply only to areas designated under section 1400Z-1 after the date of enactment.

More Opportunity Zones at closed bases
If enacted, this bill would let census tracts that include any part of a former Department of Defense installation closed in a BRAC round be eligible for designation as Qualified Opportunity Zones. States could increase the number of tracts they designate in a given period by the number of such BRAC-containing tracts nominated in that period, after applying existing paragraph limits. Investors and developers in those nominated tracts would be able to seek Opportunity Zone tax advantages. This change would apply to areas designated after the date of enactment.
Limit low-income status for closed military bases
If enacted, this bill would provide that a census tract containing a former Department of Defense installation closed in a BRAC round that does not meet the existing subparagraph (A) or (B) tests would not be treated as a low-income community for Opportunity Zone rules. That would stop investors and developers in those specific tracts from qualifying for Opportunity Zone tax benefits based on low-income community status. This change would apply to areas designated after the date of enactment.
