Census questions on citizenship status
If enacted, the 2030 census and every decennial census after would include a checkbox for each person asking whether they are: a U.S. citizen, a U.S. national but not a citizen, an alien lawfully residing in the U.S., or an alien unlawfully residing in the U.S. The Secretary would publish state counts by those four categories within 120 days after the census is completed. This would affect every household that fills out the census and would create public data that could be used for future apportionment and funding decisions.
Faster, narrower court review of apportionment
If enacted, lawsuits challenging the Act or its implementation would be expedited and heard by a three-judge federal district panel. Those panel decisions could be appealed directly to the Supreme Court, and federal officials could move state-court cases into federal court for that process. The bill would also create a presumption that revised reapportionment is lawful; a court could set aside the apportionment only on a clear and convincing showing that the Secretary exceeded statutory authority or violated an express Constitutional limit.
Recalculate House seats using citizens
If enacted, the Commerce Secretary would recalculate each State's 2020 census population using only U.S. citizens. The revised tabulation must be finished by January 31, 2027, but the Secretary could delay to March 31, 2027 with notice to Congress. The Secretary would have to use only official federal or State records, could not repeat the census, and could use statistical estimation, matching, and imputation. The President would then send Congress state citizen counts and the number of Representatives per state using the equal proportions method, with each State getting at least one seat. These changes would affect how House seats and some federal funding formulas are allocated, and changes would not apply to any Congress whose first regular session occurred before enactment.
