Summary

Excludes voluntary, after-hours education or training from "hours worked" under the Fair Labor Standards Act. The bill would change how employers count time for minimum wage and overtime by making any attendance at an education or training program or similar activity excluded from hours worked if three conditions are met. Attendance must occur outside the employee's regular working hours. Participation must be voluntary and the employer must not take adverse action for nonattendance. The employee must not perform any work for the employer while attending. The bill preserves the existing exclusion for changing clothes or washing when that exclusion is part of a bona fide collective-bargaining agreement and would apply to hours used to calculate pay under sections 6 and 7 on or after the date of enactment.
