Criminal penalties for banned items
If enacted, breaking the bans could bring a fine up to $5,000 and up to 12 months in jail for each offense. If you possess a banned semi‑automatic gun and commit or try to commit another federal crime punishable by more than 1 year, you could face an extra fine up to $250,000 and 2–10 years in prison, on top of the other punishment.
Limits on large-capacity magazines
If enacted, it would be illegal to import, make, sell, or receive magazines that hold more than 10 rounds. You could not possess magazines made after enactment. Even if your magazine was made before enactment, transferring it across state lines would be unlawful after enactment. Some government uses may be exempt under other parts of the bill.
New rules for semi-automatic guns
If enacted, the Attorney General, through ATF, would publish a list of covered semi-automatic guns within 180 days. New gun designs made after enactment would need approval before they could be made for civilian sale. The AG would decide applications within 240 days, with appeals due in 90 days and decided in 180 days. Dealers would need to record that buyers saw the list before some sales. The bill defines what counts as a gas‑operated semi‑automatic gun and related conversion parts, which would guide what is banned or allowed.
New fees for gun manufacturers
If enacted, licensed gun makers would need to apply and pay new fees set by the Attorney General within 60 days. Fees would be high enough to cover review costs. The bill would create a Firearm Safety Trust Fund to receive ATF taxes and these fees, with money available until spent.
Family and government exceptions with markings
If enacted, the federal government, states, tribes, and some nuclear‑security uses could make, import, transfer, or possess covered items. People could keep gas‑operated semi‑automatic guns made and transferred before enactment. A family transfer would be allowed only if a licensed dealer first takes possession and follows all transfer rules. “Immediate family member” would mean a spouse, parent, sibling, child, someone you act as a parent for, or a related person living in your household. Items made or imported under exemptions after enactment would need special markings, and marked magazine serial numbers could not be removed.
Buy-back payments for surrendered guns
If enacted, states, localities, and tribes could use Byrne grant money to pay people who turn in covered semi‑automatic guns or large magazines. You would get money only if you join an approved buy‑back and surrender a covered item.
